The Supreme Court has refused to issue an interim order on a writ petition filed by outgoing Managing Director Kulman Ghising against the appointment of newly appointed Managing Director of Nepal Electricity Authority (NEA) Hitendra Dev Shakya.
The Supreme Court bench of Justices Dr. Kumar Chudal and Nityanand Pandey did not issue an interim order in favor of Kulman after the hearing of the case concluded on Thursday afternoon. With this, the government has cleared the way for the newly appointed Managing Director Hitendradev Shakya to work.
The order came after the third day of continuous hearing on the case in the bench of Justices Dr. Chudal and Pandey since last Tuesday. The order was made based on the precedent that there was no order for reinstatement when the then government dismissed Hitendrev from his post like Kulman.
Ghising had gone to the Supreme Court seeking reinstatement as he had been illegally removed from the position of Managing Director of the Authority.
Meanwhile, newly appointed Managing Director Shakya had filed a petition seeking to resolve his old case. The Supreme Court has also refused to issue an interim order in his writ petition.
With this, Hitendra will have to wait for a decision on whether or not he will receive the service benefits for the vacant tenure when Kulman was appointed as Managing Director.
The judges have given priority to Hitendra’s case and ordered it to be sent to the full bench. The then government had removed Hitendra and appointed Kulman as the managing director.
